These terms and conditions outline the rules and regulations for the use of Belive App Private Limited's Website, located at https://beliveapp.site and mobile app Belive app (hereafter both called as "Belive" or "Belive app").

By accessing Belive, we assume you accept these terms and conditions. Please read these Terms and condition of Use carefully as they constitute a legally binding contract with Belive regarding the use of the Services by the Users. Do not continue to use Belive if you do not agree to take all of the terms and conditions stated on this page.

The Terms and condition of Use apply from the registration of the User on Belive app and throughout their use of the Services, whether the User accesses the Services via a wireless or mobile device, a tablet or a computer, or any other technology or device (the “Device”). Some of the functionalities made available to the users by Belive may be free or subscribed to by the Users.

For the purposes of these Terms:

“User” or “You” or “Your” refers to you, as a customer of the Services. A customer is someone who accesses or uses the Services for the purpose of sharing, displaying, hosting, publishing, transacting, or uploading information or views or pictures and includes other persons jointly participating in using the Services including without limitation a user having access to business page to manage claimed business listings or otherwise.

“Partners” or "beliver" or "Belivers" includes the shall mean the artist, performers, event organisers, venue partner, or any other third-party partner partnered with Belive.

Services Overview:

Belive is a platform for Users to avail services with respect to events, performances, meetups, ticketing, etc., listed by the Belivers on the Platform from time to time (“Services”). Services on the Platform are available to select geographies in India.

Eligibility:

Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872 are not eligible to use/access the Platform. However, if you are a minor, i.e. under the age of 18 years, you may use/access the Platform under the supervision of an adult parent or legal guardian who is “competent to contract” and agrees to be bound by these Terms.

If you are using the Platform on behalf of any person/ entity, you represent and warrant that you are authorized to accept these Terms on behalf of such person/ entity. Further, you and such person/ entity agree to be jointly, severally liable and indemnify us for violations of these Terms.

You agree to use the Services only in compliance with these Terms and applicable laws, and in a manner that does not violate our legal rights or those of any third party(ies).

Account and Registration Obligations:

All users must register and log in for adding themself to the performance guest live or view their guest list requests on the Belive. You must keep your account and registration details current and correct for receiving all communications from the Belive. By agreeing to the Terms, you agree to receive promotional, transactional, commercial or other communications, and newsletters from us. You can opt out from such communications and/or newsletters by using the opt out options as available in such communications. You can also change your notification preferences as available in your profile section of the Belive.

As part of the registration process on the Belive, access and usage thereof, we may collect your personally identifiable information/ preferences, including your name, email address, age, address, mobile phone number, and other contact details, demographic profile (like your gender, T-shirt size, occupation, education etc.) and information about the pages on the Belive you visit/access, the links you click on the Belive, the number of times you access a particular page/feature etc. Processing of such information so collected will be done in compliance with the Privacy Policy.

By registering your Email ID or mobile number with us, you provide your consent to be contacted by us directly or through a third party service provider via phone calls, SMS notifications, mobile applications and/or any other electronic mode of communication.

• Sell, rent, or sub-license material from Belive

• Reproduce, duplicate or copy material from Belive

• Redistribute content from Belive

This Agreement shall begin on the date hereof.

Parts of Belive offer users an opportunity to post and exchange opinions and information or content like artists, their events and its details or check-ins in certain areas of Belive app. Belive does not filter, edit, publish or review content before their presence on the Belive app. That content does not reflect the views and opinions of Belive App private limited, its agents, and/or affiliates. Content reflects the views and opinions of the person who posts their views and opinions. To the extent permitted by applicable laws, Belive App private limited shall not be liable for the Content or any liability, damages, or expenses caused and/or suffered as a result of any use of and/or posting of and/or appearance of the content on the Belive.

Belive App private limited reserves the right to monitor all Content and remove any Content that can be considered inappropriate, offensive, or causes breach of these Terms and Conditions or after reported by any individual via privacy@beliveapp.site after a thorough review.

You warrant and represent that:

• You are entitled to post the Content on Belive and have all necessary licenses and consents to do so.

• The Content do not invade any intellectual property right, including without limitation copyright, patent, or trademark of any third party.

• The Content do not contain any defamatory, libelous, offensive, indecent, or otherwise unlawful material, which is an invasion of privacy.

• The Content will not be used to solicit or promote business or custom or present commercial activities or unlawful activity.

You hereby grant Belive App private limited a non-exclusive license to use, reproduce, edit and authorize others to use, reproduce and edit any of your Comments in any and all forms, formats, or media.

Hyperlinking to our Content:

The following organizations may link to Belive without prior written approval:

• Government agencies;

• Search engines;

• News organizations;

• Online directory distributors may link to Belive in the same manner as they hyperlink to the Websites of other listed businesses; and

• System-wide Accredited Businesses except soliciting non-profit organizations, charity shopping malls, and charity fundraising groups which may not hyperlink to our website.
